Lottery scam: Revised notifications issued
Thiruvananathapuram 6-08-2011: The State Government has issued a comprehensive revised notification as per the Delhi Special Police Establishment Act on the lottery case.
All the issues raised by Opposition leader V S Achuthanandan and VD Satheesan MLA, with regard to the lottery scam, has been included in the revised notification.
The issues raised by the then UDF Government from 2004 before the Centre and later by the LDF Government from 2006 have been included in the new notification.
In the first notification issued on June 18, 32 cases were registered. Apart from this in the revised notification, 15 new cases have been included.
- The legal sanctity of the contract if the States of Bhutan, Sikkim, with Monica Lotteries and Megha Distributors in the sale of Lottery tickets in the State of Kerala;
- The printing of Lottery tickets in private press, violating condition stipulated in the section 4 of the Lotteries (Regulation Act) 1998;
- The drawing and distribution of prizes in single, double and triple digit lotteries violating provisions of the Lotteries (Regulation Act) 1998;
- The verification of documents and cross verification of details of Lottery Tickets sold with that of unsold tickets and ticket for which prize obtained I each draw with reference to the official documents;
- Whether the money obtained from the sale of Lottery Tickets have been deposited in the Public Ledger Account or in the consolidated fund of the States concerned, and if not, find out the destination where money reached;
- Whether the prize money was distributed from the Public Ledger Account or from the Consolidated Fund of the States concerned;
- The authenticity of the prize money winners and ascertain whether the prize money have been distributed promptly;
- Whether income tax @ 30% have been remitted towards the prize money above Rs 5000;
- Verify whether the sales tax received in respect of the sale of other State Lotteries are in accordance with procedure as stipulated in the Lottery Regulation Act 1998 ans the rules made thereunder;
- Conduct if draw in secret places without the presence of a judging committee as stipulated in the Lottery Act;
- The alleged transaction of Rs 2 Crores from the account of Lottery King Santiyago Martin to the news daily Desabhimani;
- The reason/ circumstances by which live telecast of the draw of other State Lotteries (which held in secret places) appeared in visual media like Kairali, Kairali People, SS Music etc and money transaction if any;
- The alleged nexus between Sri V.A Arunkumar son of former Chief Minister with Cherry Enterprises and the Lottery Mafia;
- The nexus between the Lottery Mafia and Politicians/ Officers of the State Government;
- A comprehensive investigation covering all aspects of the matter including the alleged evasion of Sales Tax due to the State of Kerala, in view of the fact that more than Rs 5750 Crores, as Sales Tax arrears had been swindled, between the Financial Years 2002-2003 and 2003-20004 alone, with the possible connivance of functionaries if the Commercial Taxes Department and even Government Pleaders.
